A former Rutland City police officer's civil suit alleging various acts of racial discrimination is set to go to trial.

A Rutland civil court decision filed Tuesday says that Ex-Cpl. Andrew Todd's suit against the city and several police officers has sufficient evidence to move forward.

The Rutland Herald reports  the court denied the city's motion to dismiss the case.

Todd was the only African-American police officer with the department during his nine-year tenure.

His 2012 suit alleges that his working conditions were so intolerable that he was forced to resign.

He says he was exposed to constant use of racial slurs and the repeated racial profiling of African-Americans.

Mayor Christopher Louras could not be reached for comment.

A trial date has not been set at this time.
