Vermont Supreme Court Considers Rural Road Maintenance

The Vermont Supreme Court is now considering who is responsible for maintaining little-used rural roads when people live on those roads.
The court heard arguments on the topic Wednesday during an outing to the Addison County Courthouse in Middlebury.

The town of Underhill is appealing a lower court ruling that it must maintain what Vermont designates as a Class 4 highway, which usually are not eligible for state aid and not maintained in the winter.

A lawyer for the town told the justices that Vermont law says the town "may," not "shall" maintain the roads for public good and convenience.

But the lawyer for three property owners wants to order the town to repair the 1.5 mile Fuller Road to make it safe.
