In January, New York’s highest court will have two fewer judges.  Only five of the seven slots will be filled, due to a mandatory retirement and delays by Governor Andrew Cuomo and the State Senate over confirmation hearings.

New York Governor Cuomo has until the end of this week to fill a vacancy on the state’s highest court. His choices include the reappointment of a Republican woman judge who currently holds the seat  and several Democratic alternatives.

A proposal on Tuesday’s ballot would raise the retirement age for some New York judges from 70 to age 80. Supporters include the state’s 68 year old chief judge, while opponents say the measure is too flawed to be approved.
