Disputed Foreclosed Lands Sold

All of the parcels that Clinton County placed for auction in a disputed foreclosure sale have been sold.

Clinton County sold at auction all 11 pieces of foreclosed property that the Turtle Island Trust claims officials illegally seized.   

The Turtle Island Trust holds lands for the Ganienkeh Mohawks near Altona.  

The county says state attorneys verified that any land outside of the original parcel negotiated with the tribe in the 1970's are taxable.

Native Trust Files Suit Over County Land Foreclosures

A legal battle has erupted as a trust for a Native American tribe files suit over a northern New York county’s plan to sell foreclosed lands at auction.

The Turtle Island Trust filed a lawsuit in NYS Supreme Court on Wednesday over an on-line auction sale of foreclosed properties scheduled to occur on Friday.  The trust was formed as part of an agreement between the state and the Ganienkeh Mohawks.  Turtle Island Trust Chair Reverend Don Washburn says they are challenging the legality of Clinton County’s foreclosure actions against 11 parcels.

Trust Files Suit Over Foreclosure Action

The battle over disputed foreclosed lands has led to a lawsuit in the NYS Supreme Court.

Clinton County plans to sell foreclosed lands during an on-line auction Friday.

The Turtle Island Trust filed a lawsuit challenging the legality of Clinton County’s foreclosure actions.  

Gare Smith, an attorney representing the trust, says Clinton County’s move is unprecedented.

Clinton County officials claim the lands were originally leased to the trust.
